Objective
Buzzoffsxm offers a service to connect its Users with partner merchants via its website www.buzzoffsxm.com/ and its mobile applications (hereinafter referred to as the Site).
The Site allows users (hereinafter the “Users”) to consult the products offered for sale by partner merchants (hereinafter the “Products” and the “Merchants”), to order the Products online, after registration, to pay the amount of their Order and to be delivered by a partner delivery service.

Transactions made via the Service for the purpose of selling Products are concluded directly between the Buyer and the Merchant. Buzzoffsxm does not sell the Products offered by the Merchants through the Service.

Your account
The User can access the Site and consult the Products offered by the Merchants without having to identify himself on the Site. To consult the offers proposed by the Merchants, the User must only indicate a postal address allowing to determine the Merchants available near his location.

Before you can place product orders using our Site, you must open a Buzzoffsxm account. When you open an account, you may create a password or use another secure login method, and you may also need to provide credit card information. You must keep any password you create, or other secure login method, secret and prevent others from accessing your email account or cell phone. If another person uses these methods to access your account, you will be responsible for payment of the products they order and we are not responsible for any other losses you incur, unless the person using your password obtained it because we failed to keep it secure.

You may terminate your account at any time by requesting to do so in the account section of our site or by contacting us using the contact information above. We may suspend your access to your account, or close it permanently, if we believe your account has been used by someone else. We may also terminate your account if we believe that you are abusing our service (for example, by requesting refunds or credits to which we believe you are not entitled, by filing unreasonable and repeated complaints, by abusing our staff or our independent delivery partners, or for any other valid reason).

Availability of Services
The Buzzoffsxm Service is available to all of our Merchant Partners located in the United States. Each Merchant Partner has a defined delivery area to ensure that their products reach you in the best possible way. You will need to provide a mailing address to determine which merchants are available near your location.

Price of the Service

The opening of an account and the use of the Service are free of charge (except for any connection costs), without any obligation to purchase on the Site. Only the purchase of Products from Merchants is subject to payment, under the conditions set out in the GTC.

Orders
Each order placed through our Service will be transmitted to the partner Merchant for confirmation. The order is final once it has been accepted by the Partner Merchant

We will then send you, on behalf of the Merchant Partner, an e-mail or notification to your Buzzoffsxm account thanking you for your order and confirming that it has been received and accepted by the Merchant Partner (the “Confirmation E-mail”). By placing an order with our Services, you are acting on your own behalf.

The contract for the supply of any product you order through us is between you and the Merchant Partner and is concluded only upon the sending of the Confirmation E-mail or the notification on your Buzzoffsxm account.
Please check that the e-mail address you have given us is correct as this will enable us to communicate with you about your order.

Please also verify that you are providing a correct address and phone number to ensure that your products are delivered to the correct location. If you do not open the door and answer the phone within 10 minutes of arriving at your delivery address, we reserve the right to leave and charge you for the product.

Buzzoffsxm aims to provide a quality service and is your first port of call if you have a problem with your product, whether it is a quality or temperature issue. We monitor our Merchant partners very carefully and it is extremely important to us that they meet our standards and help us maintain our reputation.

You can send us any comments you may have about our Merchant Partners by email, phone or by contacting us about your order from our mobile app.

Through the order taking process, you expressly agree to the application of these terms and conditions of service.

The products
All products are offered subject to availability. Your Dealer Partner may be able to provide an alternative for a product that we are unable to provide.

Please call our Merchant Partners before ordering if you have any allergies. Buzzoffsxm cannot guarantee that the Products sold by our Merchant Partners are allergen-free.

For products sold by weight, a maximum 5% weight tolerance will be allowed on the quantity of product delivered.

In order to preserve the quality of the fresh Products, it is recommended to put them directly in the refrigerator upon delivery.

Sale of alcohol
7.1 Alcoholic beverages may only be sold to persons over 18 years of age and proof may be required by your Buzzoffsxm delivery person (Article L3342-1 of the French Public Health Code).

Your Buzzoffsxm delivery person may refuse to provide alcohol to anyone who appears to be under the age of 18 or who is or appears to be under the influence of alcohol or medication. By placing an order that contains alcohol, you confirm that you are at least 18 years old. Any violation of this section is your sole personal responsibility.

7.2 The abuse of alcohol is dangerous for your health. Know how to consume and enjoy in moderation. By the mere fact of placing an order on our “website”, you expressly waive the benefit of Article 1587 of the Civil Code which provides that the conclusion of the sale of wine becomes final only after tasting and approval of the buyer.

7.3 If you are identified as a minor, your Buzzoffsxm delivery person will take back the entire order and the amount corresponding to this order will be refunded to you, deducted, however, from a flat fee of 12€ to compensate for the costs incurred by Buzzoffsxm Delivery and due to non-compliance with these conditions and the cancellation of the order.

7.4 In the event that a drink delivered is unfit for consumption (e.g. corked bottle), the Buyer is invited to contact Buzzoffsxm as soon as possible and no later than 24 hours after delivery in order to proceed with a refund or exchange of the product ordered.

Buzzoffsxm will then send a delivery person to collect the drink and check with the retailer that the drink is not fit for consumption. Buzzoffsxm reserves the right to refuse any exchange or refund if the drink is more than one quarter consumed and/or not returned in its original container with original cap. If the Merchant confirms that the drink is not fit for consumption, Buzzoffsxm will exchange or refund it at no cost to the Customer.

Availability and Delivery
Our goal is to ensure that you get the best possible delivery service.

Unfortunately, things don’t always go according to plan and unforeseen circumstances such as traffic or weather conditions can sometimes prevent us from achieving our goals, or those of our Merchant partners, in this regard. We make every effort to ensure that your product is delivered within the time frame indicated in the email and on the web page.

The delivery time of your order is determined by the number of orders and the conditions to which the Merchant Partner is subject at that time.

Cancellation
The User does not have the possibility to cancel the final Order.
You have no right of withdrawal, under the provisions of Article L121-21-8 paragraph 4 of the Consumer Code, the products, objects of the contract being perishable goods.

Prices, Payment and Promotional Offers
10. Prices, payment and offers
The prices include VAT. You confirm that you are using our Service for personal, non-commercial use. Buzzoffsxm may sometimes engage in dynamic pricing, which means that prices for Products and Delivery may change while you are browsing. Prices may also change at any time at the discretion of the Merchant Partners. We reserve the right to charge a Service Fee, which is subject to change, for providing our Services. These Service Fees may vary. You will be informed of the Service Fee and applicable taxes prior to purchase on the payment page of our Site. No changes will affect existing confirmed orders, except in the case of an obvious pricing error.

Price changes will also not affect orders in process and in your shopping cart, provided you complete the order within 2 hours of creating the cart. If you do not complete the order within the 2 hour period, the Products will automatically be removed from your cart and the price change will apply.

If there is an obvious pricing error, we will notify you as soon as possible and you will have the option of confirming the order at the original price or cancelling the order at no charge and with a full refund of any money already paid. These Delivery Charges will be notified to you during the ordering process before you confirm your order.

The total price of your order will be shown on the checkout page of our Site, including the prices of the Products and Delivery as well as any Service Fees and applicable taxes.

Payment for all Products and Delivery can be made on our Site by credit or debit card, or by any other payment method offered by Buzzoffsxm. Once your order has been confirmed, your credit or debit card will be authorized and the total amount will be shown for payment. Payment is made directly to Buzzoffsxm acting on behalf of the partner store only. Payment can also be made using Vouchers or Account Credit. Use of these is subject to Buzzoffsxm’ Voucher and Account Credit terms and conditions.

Merchant partners sometimes offer promotional offers through our Site. These offers are visible when you view a Merchant Partner’s store menu.

These offers are at the discretion of the Merchant Partners. Unless the terms of the offer specify a fixed or minimum period during which an offer will be available, it may be withdrawn at any time, unless you have already placed an order based on the offer and we have sent the Confirmation Notice.

Tips
When placing your order:
When you place an order, you have the option of paying a tip to the delivery person or Merchant in addition to the purchase price of the Products in your order. All payments will be collected by Buzzoffsxm using the same payment method used for the original order. Your delivery person or Merchant partner will receive 100% of any tip you choose to make.

After we receive your order:

Once you have received your order, you may receive a notification giving you the option to pay a tip to your delivery person. Buzzoffsxm will collect the payment on behalf of the delivery person, as a limited payment collector, and the tip payment will be considered a direct payment from you to the delivery person.

We will communicate your first name to your delivery person when we notify them of the tip. Your delivery person will receive 100% of any payment you choose to make. Since this payment is made after you receive your order, it is non-refundable and not part of your order. Depending on the payment method used for your original order, your tip may appear on your bank/credit card statement as a separate payment.

Our Liability
To the extent permitted by law, Buzzoffsxm provides its Service and content on an “as is” and “as available” basis.
As set out below, neither Buzzoffsxm nor any Merchant Partner shall have any liability to you for any direct, indirect, special, contractual, tort (including negligence) or other losses arising out of your use of or inability to use our Service.

If Buzzoffsxm or the Merchant Partner is liable to you, our total cumulative liability is limited to the purchase price of the products you paid for in your order. This does not include or in any way limit the liability of Buzzoffsxm or a Merchant Partner in respect of any matter for which it would be illegal for us to exclude or attempt to exclude our or their liability, in particular, liability for death or personal injury caused by negligence or fraud or fraudulent misrepresentation.

The sales contract is concluded between you and the Merchant. The Merchant partner you choose is an independent merchant, separate from our company, over whom we have no control. Consequently, apart from the strict legal conditions, we cannot be held responsible in this respect.

The merchant partner, seller, is responsible for defects in conformity of the goods to the contract under the conditions of Article L 211-4 of the Consumer Code and defects of the thing sold in case of latent defects (Article 1641 Civil Code) and the legal guarantee of compliance (Article L211-4 and following Consumer Code).

In addition, in accordance with article 6-I, 2 and 3 of the law n° 2004-575 of June 21, 2004 for the confidence in the digital economy, Buzzoffsxm could not see its responsibility committed because of the contents made available on the Site by the Purchasers or the Merchants, in particular as regards the description of the Products or the appreciations which the Purchasers make of the Merchants, except if it did not make them promptly inaccessible after having been informed of their illicitity under the conditions envisaged by this law.

Events Outside Our Control
Neither party shall be liable to the other for any delay or failure to perform its obligations under this Agreement if such delay or failure is beyond its reasonable control including, but not limited to, acts of God, governmental action, war, fire, flood, explosion or civil commotion.

Personal data

Personal data concerning you are processed by Buzzoffsxm.

Purposes:

Your account and order information is processed to create and manage your account, manage your orders and their follow-up, as well as for fraud prevention, statistical analysis and customer knowledge purposes. Buzzoffsxm also uses your data for marketing and targeted advertising purposes (sending electronic communications, postal or telephone canvassing and advertising profiling by combining data) on its own behalf or on behalf of partners in the context of its advertising network.

Depending on your choices, your contact data and profile information may be transmitted to advertising agencies or commercial partners for the purpose of commercial prospecting and advertising targeting.

You can learn about and refuse at any time the use of your data related to commercial prospecting and advertising profiling by writing to (email).

Transfers of data:

Your data is transferred to the Merchants and delivery agents for purposes strictly limited to the management and delivery of Orders placed on the Site, as well as to enable them to meet their legal and regulatory obligations where applicable. These transfers are strictly necessary for the execution of the orders that you place with these Merchants.

In accordance with the regulations on the protection of personal data, you may exercise your rights (access, rectification, deletion, opposition, limitation and portability if applicable) and define the fate of your personal data “post mortem” at the following address (email) or by post to the address Buzzoffsxm   ………………………………………………………………, accompanied by a copy of a signed identity document.

Partial nullity
If one or more stipulations of these GCU Buyer are held to be invalid or declared as such in application of a law, a regulation or a final decision of a competent court, the other stipulations will keep all their force and all their scope.

Indivisible Contract
These Terms contain the entire agreement between the parties relating to its subject matter and supersede all prior agreements and understandings between the parties relating to such subject matter.

Our Right To Amend These Terms Buzzoffsxm may revise these terms at any time by updating this page. You are expected to check this page from time to time to take notice of any changes we have made as they are binding on you.

Law And Jurisdiction

The French courts shall have jurisdiction over all claims arising out of or relating to any use of our Services. These Terms of Use and any dispute or claim arising out of or relating to these Terms of Use or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with French law. In accordance with the provisions of the French Consumer Code, you may have recourse to an alternative dispute resolution method or a conventional mediation procedure.

No discount, coupon or code may be redeemed for cash or any other alternative and has no cash value.

Cancellation of any order will invalidate the code used on the account.

Any discount, coupon or code can only be used on a single order, and any credit remaining after deducting such discount, coupon or code cannot be carried over to additional or subsequent orders.

If for any reason a discount, coupon or code becomes invalid due to technical problems or any other reason beyond the control of Buzzoffsxm, or if a product or Merchant is unavailable, Buzzoffsxm reserves the right (subject to any written provisions under applicable law) to cancel, suspend or modify the campaign related to that discount, coupon or code, without reissuing any additional discount, coupon or code to the customers affected.

Where applicable, Buzzoffsxm reserves the right to take any steps it deems reasonable to protect against fraudulent or invalid claims, including, without limitation, the right to require further verification of winner’s identity, age, and other relevant details.
